In Green v. Green (Reid),

Stephen W. Pate with Pate and Knott was counsel of record for Michelle Ann Green Reid, being the mother of the parties minor children, the Juvenile Court ruled that the parties minor children were dependent and neglected therefore, removing the children from the custody of mother and placing the children in the custody of father. On appeal de novo to the Circuit Court for Rutherford County, Tennessee, the trial court reversed the Juvenile Court and found on the date of the trial before the Circuit Court, all factors constituting dependency and neglect by the mother had been corrected or removed and therefore the children were not subject to any further potential danger or harm and to return the children to the custody of mother. On appeal to the Court of Appeals of Tennessee, Middle Division at Nashville, the appellate court affirmed the circuit court's ruling, that as the minor children were not dependent or neglected on the date of the new trial before the circuit court judge, the action by father for dependency and neglect was dismissed and the children were ordered to be returned to the custody of mother.
