In Hayes v. Pierret,
the trial court in Williamson County, Tennessee dismissed ex-husband's petition for change of custody of the parties minor children, finding that ex-wife should remain as the primary residential parent based upon no material change of circumstances having occurred regarding the parties custody arrangement with their children subsequent to the entry of the final decree of divorce. Trial court further ordered that ex-wife shall be designated to make all medical decisions regarding the parties minor children, based upon ex-wife being primarily responsible for medical decisions for the children. Stephen W. Pate, with Pate and Knott as attorney record for ex-wife, Lisa Gail Hayes, on appeal, the Court of Appeals of Tennessee, Middle Division at Nashville, affirmed the trial court's ruling that by ex-wife remaining as the primary residential parent of the minor children and making all medical decisions regarding the children was ultimately in the children's best interest.
